Process of Trademark Registration

  • Advertisement in Journa: When Registrar accepts the application then the application advertises in Journal. At this point, if any third party has any kind of issue related to the Trademark similarities, they can oppose the application within four months of advertising.
  • Opposition Process: When any Opposition/ third party opposes the application, TM Registry marks the application as opposed. Here, the applicant has to give the necessary counterstatement and supporting evidence to defend the opposition.
  • Registration: If the application has not faced opposition or the opposition period has been successful, the Trademark is fully registered. From this point, the applicant starts using the symbol ® in front of their mark or brand name. This symbol ( ® ) determines that the brand is registered.

This whole process may take 6 months to 24 months from TM application to Register a Trademark. It might be increased or decreased according to the complexity of the Trademark application.
