Process of Trademark Registration

  • Trademark Search: Before applying for Trademark registration the applicant goes for the ™ search. It helps to determine the trademark availability and prevent infringement.
  • Trademark Application Filing: Filing Trademark Application is the first step toward registration. This process takes 24 hrs, from this moment the applicant can start using the ™ symbol in front of their logo or brand name. This symbol (™) determines that the Brand is in the process of registration.
  • Examination of Application: Just After filing the application for registration, the application goes for Examination by the Government department. At this stage, the registrar inspects the trademark’s similarities to other registered trademarks.
  • Advertisement in Journal: When Registrar accepts the application then the application advertises in Journal. At this point, if any third party has any kind of issue related to the Trademark similarities, they can oppose the application within four months of advertising.
  • Opposition Process: When any Opposition/ third party opposes the application, Trademark Registry marks the application as opposed. Here, the applicant has to give the necessary counterstatement and supporting evidence to defend the opposition.
  • Registration: If the application has not faced opposition or the opposition period has been successful, the Trademark is fully registered. From this point, the applicant starts using the symbol ® in front of their mark or brand name. This symbol ( ® ) determines that the brand is registered.
